In this privacy notice, references to ‘we’ or ‘us’ mean TRS Staffing Solutions and our group companies, affiliates and subsidiaries. By ‘you’, we refer to the following, as applicable: (i) candidates who use our services, including uploading documents (such as their CV or Resume) via our website or completing assessments; (ii) individuals who register to use our site; (iii) individuals who contact us or express an interest in our services (e.g., subscribe to receive marketing information, submit a query, register for events or attend events we host, or otherwise correspond with us); (iv) website visitors or those who visit our offices or premises; (v) individuals who otherwise directly interact with us or other services which refer to this website; (vi) business contacts (including existing and prospective clients or suppliers); and (vii) and individuals interacting with us in connection with any other websites, mobile applications, or services that link to this privacy notice.

Personal data is information that identifies, relates to, describes, can be used to contact, or could reasonably be linked directly or indirectly to you.

Who is the controller of the data that you provide to us?

The entity that acts as controller of your personal data depends on which of our group companies provides our services to you, engages with you or otherwise determines the purposes and means of your personal data. This includes, for example: TRS Staffing Solutions in the United Kingdom; TRS Staffing Solutions Belgium BV in Belgium; TRS Staffing Solutions GmbH in Germany; TRS Staffing Solutions Limited in Ireland; and TRS Staffing Solutions B.V. in the Netherlands, and other applicable group companies operating in the jurisdictions in which we provide services. About the information we collect and hold

If you register to use the site, we will collect both personal data about you (such as your name and contact details), as well as personal data that may be considered sensitive in certain countries (such as certain information in your CV) where permitted under applicable data protection laws, as described further below.

We outline here generally how we may use personal data, with additional details provided in the table below:

  • To provide our recruitment and career services to you (including on either a temporary/contingent or long-term basis) and to facilitate the recruitment process, including conducting pre-employment screening.

  • To evaluate your candidacy against vacancies that may be suitable for you.

  • To send your information to clients in order to apply for jobs or to assess your eligibility for jobs.

  • To allow you to participate in interactive features of our service should you choose to use those features.

  • To market our full range of recruitment services to you (both permanent and contract services) and keep you informed about job openings that may arise, including those which we consider you may be suitable for.

  • To enable us to perform data analytics to evaluate your engagement with our website and to services and improve the performance and user experience of our website and services.

  • To send you updates and details of company news and other information, such as reports, promotions, offers, networking and client events, as well as general information about the industry sectors which we think might be of interest to you.

  • To communicate with you, for example, about the recruitment process and to answer your questions and enquiries.

  • To conduct appropriate background checks where necessary and proportionate, consistent with applicable law.

  • To comply with our legal obligations or exercise or defend our rights or the rights of a third party, including participating in compliance audits and complying with requests from regulatory or law enforcement agencies if we believe in good faith that we are required by law to disclose personal data, such as in connection with the detection of crime, the collection of taxes or duties, in order to comply with any applicable law or order of a court of competent jurisdiction, or in connection with legal proceedings.

·       Where necessary, to investigate, prevent or take action regarding suspected or actual illegal activities, fraud, situations involving potential threats to the rights and safety of any person, or to otherwise enforce this privacy notice.

You are required to provide (by law or under the terms of your contract with us) or we are required by law to obtain the categories of information marked * above to us to enable us to verify your right to work and suitability for vacancies, to pay you, and to administer statutory payments such as statutory sick pay (SSP). If you do not provide this information, we may not be able to work with you. 

You will be able to work with us but may not be able to work in certain vacancies unless you provide the information marked ✝ above. 

Data disclosures

Your personal data may be disclosed in the following circumstances, as summarised below. For specific disclosures, see the table above.

·       Information we obtain may be transferred between our group companies primarily for the purposes of recruitment, payroll processing, and financial reporting both within and outside the UK or EEA.

  • We disclose information to our clients as set out above.

  • We disclose information to third parties, such as service providers, where we have retained them including to provide services that you or our client have requested including to determine eligibility for hiring, such as verifying references, qualifications, and, where permitted, administering background and criminal reference checking services, verification of the details you have provided from a third-party source, psychometric evaluations or skill tests.

  • We disclose information with other relevant third parties and benefits providers, including regional Revenue & Customs as well as relevant pension schemes.

·       We may disclose your personal data to comply with the law, a judicial or administrative proceeding, court order, or other legal process, such as in response to a court order or a subpoena, or to protect the rights and safety of us and others, as set out above.

 

·       If (i) we or our affiliates are or may be acquired by, merged with, or invested in by another company, or (ii) if any of our assets are or may be transferred to another company, whether as part of a divestiture, bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected about you to the other company. As part of the business transfer process, we may disclose certain information to lenders, auditors, and third-party advisors, including attorneys and consultants.

  • We may also disclose your personal data with your consent, where permitted by applicable local law.

Where information may be held and transferred internationally

Information may be held at our offices and those of our group companies, and third-party agencies, service providers, representatives and agents as described above. Information may be transferred internationally to other countries around the world, including countries that do not have data protection laws equivalent to those under applicable law, such as laws in the EU or UK as recognised by EU/UK governmental authorities, for the reasons described above.

Where legally required, we have put in place appropriate safeguards, including the Fluor Data Protection Binding Corporate Rules Policies (EU and UK) and contractual commitments (as applicable) to protect your personal data.

Your rights

You may have certain rights in relation to the personal data we hold about you, subject to applicable law, including rights to:

·       Withdraw consent, (i.e. to stop processing your data);

·       Object to our use of your information;

·       Ask that we transfer the personal data you gave us to another organization, or to you, in certain circumstances (referred to as data portability);

·       Request that we correct, rectify or update data we hold about you; and

·       Ask for it to be erased.

Retention

Your personal data will be held for only so long as it is needed for our purposes as described above, and in accordance with applicable corporate document retention schedules. These schedules are designed to align with applicable data privacy and other legislation, and to assist us in maintaining business records which it may need to conduct its business and to respond to lawful requests for information in connection with legal claims or disputes.

Keeping your personal data secure

We have security measures in place designed to prevent personal data from being accidentally lost, used or accessed in an unauthorised way. For example, we limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality. We assess and update these measures regularly.

If we make changes that materially affect our practices, with regard to the information we have previously collected about you, we will endeavour to notify you.

The disclosures in this section apply only to California residents, and supplement this privacy notice with information required by the California Consumer Privacy Act (“CCPA”). If you are a California resident, this disclosure is also intended to serve as the Notice at Collection under the CCPA.

We do not “sell” or “share” personal data for “cross-context behavioral advertising” (as those terms are defined under the CCPA), nor do we knowingly “sell” or “share” the personal data of consumers under 16 years of age.

We retain this data in accordance with our retention policy, described above. We do not use or disclose your sensitive personal data for purposes other than permitted under applicable law.

We may also deidentify or anonymize your data in such a way that you may not reasonably be re-identified by us or another party, and we may use or disclose this deidentified data for any purpose. To the extent we deidentify any data originally based on personal data, we will maintain and use such data in deidentified form and will not attempt to reidentify the data.

Your rights

You may have certain rights regarding our processing of your personal data under the CCPA. This includes rights to:

·       request information about our processing of your data;

·       request a copy of your personal data;

·       rectify, correct, or update the data we hold about you;

·       request deletion of your data; and

·       not be retaliated against for exercising your rights.

These rights may be limited or denied in some circumstances. For example, we may retain your personal data where required or permitted by applicable law.

If you would like to exercise one or more of these rights, you can submit your request to dataprivacy@trsstaffing.com.You or your authorized agent may be asked to provide information such as your email address, name, date of submission, relationship to us, and the nature of your request so that we can verify your request. Authorized agents may also be required to provide a copy of the consumer’s signed permission authorizing the agent to submit requests on the consumer’s behalf.
